These Terms of Use (“Terms”) apply to any user on the website located at www.405FreezeShop.com, including its sub-domains, mobile-optimized versions, and any products or services accessible through it (collectively, the “Website”). 

The Website is owned and operated by 405 Freeze Shop, a company registered in Oklahoma, USA (“Company”, “We”, “Our”, or “Us”). 

These Terms set out a legally binding agreement between you as a user of the website (“User”, “You”, “Your”, “Customer”, or “Shopper”) and Company. 

If you do not want to be bound by these terms, then do not use our website. 

All other terms, policies, disclosures, disclaimers, and other provisions we may post on the Website from time to time are a part of these Terms. 

Acceptance of Terms

Each time you use or access the Website, including webpages contained or hyperlinked therein, you expressly confirm your agreement to these Terms. 

We reserve the right to modify, suspend, or discontinue the Website at any time for any reason, in part or whole, with or without notice to you. You agree that we will not be liable to you or any third party for any modification, suspension, or discontinuance of the Website. 

The Website may contain typographical errors, inaccuracies, inconsistencies, or omissions, which we reserve the right to correct, change, or update at any time for any reason, with or without notice to you.

Users Under 18

If you are under 18, you are prohibited from using the Website. If you use the Website, you represent that you are over 18 years of age. 

Authorization

You represent, warrant, and covenant that: (1) you have full power and authority to accept, to grant all authorizations, and to perform all obligations under these Terms; (2) you will use the Website for individual purposes; and (3) the address you provide when registering is your address of record. 

You will not allow any other person to use your login information to access the Website. If you become aware of any unauthorized use of your account or login information, you will immediately notify us at info@405FreezeShop.com. 

Terms and Termination

These Terms become effective on the date of: (1) your initial use of the Website; or (2) your initial access to any services accessible via the Website. The terms and these Terms will continue until terminated by us in writing. The terms will be renewed each time you access or use the Website following any updates we post from time to time. 

We may suspend or terminate these Terms and your use of or access to the Website in our sole discretion, at any time, for any reason, with or without prior notice to you, including without limitation if you engage in any conduct prohibited by these Terms, or if you otherwise violate any provisions of these Terms. Immediately upon such termination, you will cease all use of or access to the Website and its contents. 

Return and Refund Policy

We take great care to ensure the quality of our products. If, however, you receive a damaged item, please notify us within 3 days of receiving your order and include photos of the package and the damaged items. We will promptly replace the damaged item at no additional cost. 

Please note that we do not accept returns for products due to the nature of the items we sell. 

Because we are a small business, refunds are considered on a case-by-case basis for special circumstances. If you have concerns about your order, please contact us at info@405FreezeShop.com to discuss your situation. 

Shipping / Delivery Policy

Your total shipping / delivery charges are based on the shipping methods selected, the subtotal of your order, and any applicable surcharges. 

Additional shipping charges may apply to some items ordered from 405 Freeze Shop because of the size, weight, or special handling requirements. If an additional shipping charge applies, the charge will appear after you add the item to your shopping cart. 

We are sorry, but due to licensing and distribution restrictions, our merchandise is restricted to domestic shipments only. We are unable to ship internationally and to freight forwarding companies. 

Please note that USPS does not provide guaranteed delivery in the event of extreme weather conditions that may cause delays. In the event that your order might be delayed due to the weather, please contact the shipper directly to verify the rescheduled delivery. Please note that USPS and 405 Freeze Shop does not refund shipping due to these delays.

Lost Orders

All orders come with USPS tracking. In the event USPS loses your order, 405 Freeze Shop will file a claim on your behalf. In addition, 405 Freeze Shop will re-send the items you purchased after ten (10) days of no tracking for your order. 405 Freeze Shop and the USPS will not refund your shipping cost due to lost orders. 

Online Order Problems

In the event of an online order problem, please notify us at info@405FreezeShop.com as soon as possible so we can remedy the issue. In the event of an online order problem, 405 Freeze Shop reserves the right to cancel your order. Order problems may include, but not limited to, items that show a significant discount or free when there is no valid promotion and items that are out of stock or seasonal but show available for purchase on the site. 

Purchases and Cancellations

Despite our best efforts, 405 Freeze Shop may need to cancel orders that it is unable to fill or accept or where typographical or pricing errors exist. We reserve the right, in our sole discretion, to cancel any order at any time and correct any typographical or pricing errors. We will contact you if additional information is needed to confirm or accept an order or if any portion of your order is cancelled for any reason. If any part of your order is cancelled, 405 Freeze Shop will issue a credit to your card in the amount of the charge. By placing an order with 405 Freeze Shop, you represent and warrant that all billing and other information provided to us via the 405 Freeze Shop Website is truthful and accurate. Providing inaccurate or untruthful information may constitute a breach of the conditions you have agreed to by using the 405 Freeze Shop Website. By confirming your purchase of merchandise during checkout, you also agree to accept and pay for the merchandise. 

Product Descriptions

405 Freeze Shop attempts to accurately portray products through the use of product images and descriptions. However, we do not warrant that product descriptions, colors, images, or other content found on this site is accurate, complete, reliable, current, or free from errors. If a product is offered on our website is not described accurately, your sole remedy is to contact us within 5-business days of receipt of the item and allow us to remedy the situation. Coupon Acceptance Policy

From time to time, 405 Freeze Shop will offer promotions via online coupon codes. All coupon codes must be entered at time of checkout and cannot be added after purchase. Once the order is placed, 405 Freeze Shop cannot cancel orders because coupon codes were not entered.

405 Freeze Shop reserves the right to cancel orders based on coupon abuse. Coupon abuse could include giving out coupon codes for only your use to others. We also reserve the right to cancel orders after the promotional coupon code has expired but is still in use.

405 Freeze Shop allows one coupon code per order. 

Form of Payment Terms

405 Freeze Shop accepts all major credit / debit cards and cash. Checks will be allowed on a case-by-case basis. Please email us at info@405FreezeShop.com if you would like to use a check. Items ordered and paid for by check without prior authorization will be cancelled. All items that will be shipped or delivered will be charged applicable fees. 405 Freeze Shop will collect appropriate amounts for sales taxes on each order, where applicable. 

You authorize 405 Freeze Shop to charge the applicable form of payment for purchasing of goods, collection of taxes, surcharges, and shipping fees. You agree that you will not submit a chargeback after purchase is made for any reason. 

Order Cancellations

Your order processing begins immediately upon submission of your order and depending on what stage your order is in; you may not be able to cancel it. To find out if your order is still available to be cancelled, please call (405) 351-6038. 405 Freeze Shop reserves the right to cancel orders where issues arise (false form of payment, scams, online order problems). 

Allergens

While we take every precaution to prevent cross-contamination, but please be aware that our products are produced where allergens may be present. Common allergens include, but are not limited to, peanuts, tree nuts, milk, soy, wheat, eggs, fish, and shellfish. If you have food allergies, please exercise caution and consider the potential risk.

You further agree that the communication will not cause injury to any person or entity, will not contain materials deemed to be obscene, libelous, threatening, commercial solicitations, “SPAM”, or include software containing viruses or other malicious software.

The layout, contents, and arrangement of the 405 Freeze Shop Website are the property of 405 Freeze Shop, or used with the express permissions of its suppliers, and protected by U.S. copyright law.

Links to third party websites from 405 Freeze Shop are provided solely as a convenience to you. 405 Freeze Shop has not reviewed each site for its content and does not endorse or make any recommendations about them, or the information, products, materials, or software that may be obtained by using them. If you decide to access any third-party website, you do so at your own risk and 405 Freeze Shop shall have no liability arising out of the operation or content of such third parties. 

Reviews, Submissions, and Other Content

405 Freeze Shop welcomes your comments and feedback, but asks that you do not submit any confidential, proprietary or trade secret information through this site. All comments, feedback, notes, ideas, and communications sent to us shall be and remain the exclusive property of 405 Freeze Shop. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Oklahoma, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Canadian County, Oklahoma.
